According to Los Angeles Times, the Tosh.0 production assistant went to a neighbors home in West Hollywood on Monday to try to stop a man who was holding hostages. When John Winkler exited the apartment with of those hostages, cops shot him, thinking he was the assailant.

Alexander McDonald has since been charged with murder, attempted murder, and torture in connection with the events that led to John Winklers death. McDonald, a computer programmer with no criminal history, pleaded not guilty and is currently being held on $4.12 million bail.
